Sheffield united’s claim to order a new disciplinary commission to deal with West Ham’s illegal purchase of Carlos Tevez has been dismissed by the an arbitration panel on the grounds that they did not have the power to overide the decision made by an independent commision.
The resultant decision means that Sheffield United will begin life next season in the championship. They also had another claim dismissed; stating that the premiership should of forced West Ham to de-register Carlos Tevez.
West Ham disobeyed premiership rules by welcoming third party agreements when they signed Carlos Tevez and Javier Marscherano from Corinthians last summer. For their involvement in the illegal purchase of the Argentines, they were fined 5 million pounds by an independent commission. Sheffield United however felt that they should of been deducted points instead.
Sir Phillip Otton the chairman of the panel admitted that he would of deducted points had he lead the initial tribunal, but as it were he would not overturn the decision made by an independent disciplinary panel.
Speaking yesterday he said : “We have much sympathy for the aggrievances arriving from the decision and the manner it was arrived at. We would go so far as to say that the tribunal would in all probability hve reached a different conclusion and deducted points from West Ham.”
He went on to say: “The tribunal had to test the original decision on the basis of whether it was it was irrational or perverse when it was reached”
“We are obviously very dissapointed at the conclusion and, in particular the circumstances where the tribunal recognised that the outcome of the decision turned out to be, in the panels own words, unfortunate in the extreme and that Sheffield United had done nothing wrong to merit this outcome”
